Elon Musk, the visionary behind SpaceX, Tesla, and X, has taken legal steps against OpenAI and its CEO, Sam Altman, over what he claims is a departure from their original non-commercial agreement. The lawsuit, lodged in the Superior Court of California for the County of San Francisco, centers on Musk's concern that OpenAI's partnership with Microsoft strays from its mission to develop artificial general intelligence (AGI) as an open-source boon for humanity.


In the lawsuit, Musk outlines several grievances including breaches of contract, violations of fiduciary duty, and engaging in unfair competition. He is pressing for OpenAI to revert to its commitment to open-source development and is seeking a court order to block the use of AGI technology for profit.


The filing points specifically to the release of ChatGPT-4 in March 2023 as a stark deviation from OpenAI's original ethos. Musk contends that, unlike its predecessors, GPT-4's restricted access model primarily serves Microsoft's financial interests, moving away from the nonprofit ideals that OpenAI was built upon.


Originally established in 2015 as a nonprofit dedicated to AI research for the greater good, OpenAI has morphed into a significant commercial entity since introducing a business division in 2020. Musk, a founding member of OpenAI, critiques the organization's pivot towards profit, arguing it now prioritizes financial gains over societal benefits.


Information from the Financial Times indicates that OpenAI's revenue streams have surged past $2 billion a year, largely thanks to the phenomenal success of ChatGPT. This financial boom has marked OpenAI as a powerhouse in the tech industry's rapid growth sector.


Musk has long voiced concerns over AI's potential risks to humanity, advocating for stringent oversight and the ethical progression of AI technologies. He has called for comprehensive understanding and regulatory intervention to mitigate these risks.


The lawsuit also challenges the competence of OpenAI's board, accusing it of lacking the necessary technical insight to steer AGI's responsible advancement. Musk points to the recent turmoil involving Altman's ouster and subsequent reinstatement as CEO as symptomatic of a commercial agenda that favors Microsoft's financial interests over ethical considerations.


Musk, who served on OpenAI's board until stepping down in 2018, ties the internal conflict directly to the strategic direction of ChatGPT-4 and forthcoming AGI projects, raising alarms over potential safety risks to the public.
